Investor Visas and Treaty Trader Visas

There are two kinds of non-immigrant E visas--the E-1 visa and the E-2 visa .

The E-1 visa is a treaty trader visa. In order to qualify, the treaty trader must:

  • Be from a country which has a treaty or trade agreement with the United States
  • Be coming to the United States to carry out substantial trade or to develop and direct the operations of an enterprise that has commercial trade with the applicant's country of nationality.

The E-2 visa is an investor visa. In order to qualify, the treaty investor:

  • is required to come to the United States to develop and manage the operations of an enterprise in which the applicant has invested or is actively in the process of investing a substantial amount of capital. In addition to the investment in a business enterprise, the investor must be coming to the United States to develop and direct the operations of the enterprise in which he or she has made the investment. The applicant must have more than fifty (50%) percent ownership of the investment, unless the applicant is coming as an employee of the enterprise.

There is another investor visa called the EB-5. This visa is an immigrant visa, meaning that you can come to the United States as a lawful permanent resident. We can help you obtain an EB-5 visa on a current or future investment. We can also help you evaluate the merits of an investment in a limited partnership that promises to satisfy the requirements for your EB-5. P and O Employment Visas

O and P visas go to accomplished athletes, entertainers, and artists. In many instances, the alien is required to produce proof of national, or even international, recognition.

P visas go to athletic teams or performance groups. Possible recipients include:

  • Sports teams
  • Backup bands for O visa recipients
  • Orchestras
  • Theater companies
