Crimes and Immigration

If you have been convicted of

  • A crime involving a controlled substance;
  • An aggravated felony;
  • A crime involving moral turpitude;
  • A domestic violence crime;
  • And any other criminal offense.

According to the Immigration and Nationality Act (INA), you can be deported or denied entry into the country for almost any crime. You could also be subject to mandatory detention (held without bail by the immigration authorities) if you were released from prison or jail after October 8, 1998. Even if you have been a legal permanent resident since you were a month old, the rule still applies.

Post Conviction Relief

A mere expungement is not enough to prevent deportation. However, there are other options. A criminal court is required to follow certain procedures and safeguards when accepting guilty pleas in criminal matters. If these procedures and safeguards are not followed, then the criminal conviction may be vacated, which means that the conviction is invalid for immigration law purposes. If you pled guilty to a deportable offense, or an offense that prohibits your admission to the United States, we can review your criminal case file and evaluate your chances for post conviction relief (eliminating the conviction for immigration purposes).
