Am I eligible for asylum?

In the US, an asylum seeker must prove that he or she:

"Has a fear of persecution based on race, religion, national origin, membership in a particular social group, or political viewpoint."

Examples include:

• A Guatemalan peace activist whose colleagues have been "disappeared" by the police
• A Saudi woman who refuses to wear the veil and participate in an arranged marriage
• A Ugandan who was harassed, and whose home was raided by the police because she was a lesbian
• A Christian convert from Afghanistan who faces the death penalty for practicing his religion

Other Remedies

Temporary Protective Status (TPS)

This remedy is only available to people from certain countries. Contact our office  to find out whether your country is on the list. You only have a limited time to file for TPS, so the sooner you call, the more likely it is that you will be able to file.

Withholding of Removal and Convention Against Torture (CAT)

If an asylum claim is out of reach, you may be able to apply for relief from deportation in the form of Withholding of Removal or the Convention Against Torture. The standards of proof for these provisions are high. However, they may be an alien's only defense against deportation.
